Blood Alcohol Content

Sacramento DUI Lawyer

California Vehicle Code §23152 makes it unlawful for anyone under the influence of alcohol or drugs to drive a vehicle with blood alcohol content (BAC) of .08% or above. Commercial drivers who operate semi-trucks or other commercial vehicles will lose their license for a year if their BAC is 0.04% or above while they are driving their work vehicle. Losing a Commercial Driver’s License (CDL) can have a drastic impact on the career and profession of commercial drivers, and must be avoided at all costs. Our state also has zero tolerance laws for underage drivers. This means that drivers who are younger than 21 can be arrested for DUI if their BAC is 0.01%. California law also states that it is illegal to have a BAC of .01% or higher if you are on DUI probation.

DUI Penalties

When you are arrested on suspicion of DUI, you will face legal action from the DMV and the court as well. If you do not request a DMV hearing within ten days of your DUI arrest, you will automatically lose your driving privileges for a minimum of six months. A DUI charge is no laughing matter, and it can have lasting ramifications on a driver’s life. The other types of penalties in a DUI case can include:

  • Probation
  • Jail time
  • Fines
  • Court-ordered alcohol treatment
  • Installation of an ignition interlock device
  • Vehicle impoundment

A DUI conviction can also result in increased insurance rates and points accrued on your driving record. An exceedingly high BAC or a DUI involving an accident with injuries will often result in penalty enhancements. If you have been charged with DUI, contact a skilled DUI attorney at once to discuss your defense options. Having the strong representation of a qualified lawyer is vital when defending these serious accusations.

Were You Over the Legal Limit?

Under California state laws, a licensed driver has given their implied consent to provide a breath, urine, or blood test when asked to do so by law enforcement. If you refuse testing, your license will be automatically suspended. Instead of taking a chance with your future and these serious penalties, it is far better to contact a legal professional who you can count on.

My name is J.M. and as a police officer, I was shocked and appalled when I was falsely charged with crimes I did not commit. Mike Wise got the case thrown out of court and even got the judge to declare me factually innocent. Cops know who the good attorneys are. When I was falsely accused of a crime...
