Post Trial Process

Sacramento’s Post-Trial Process

Motion for a New Trial, Writs, and Appeals

At the end of a trial the verdict is rendered. If the verdict is guilty a sentencing hearing will be scheduled which gives the defense and the prosecution an opportunity to present their views concerning appropriate sentencing to the judge. If you have been found guilty of one or more charges, you may wish to appeal. An appeal is simply a review of the facts and applicable law of a trial to see if the verdict was legally and procedurally sound.

You also have the option of filing a motion for a new trial due to an error or other factor which affected the outcome of the first trial. A Sacramento criminal defense attorney with extensive trial experience can advise you on the options open to you. It is very important to take fast action as the window of time for moving for a new trial or filing an appeal is limited.

Criminal Defense Lawyer in Sacramento, CA

Since the appellate court is only concerned with the law, the facts and the events in your original trial you need valid grounds for an appeal such as:

  • Legal procedural errors
  • Discovery of new evidence
  • Jury errors
  • Improper rulings under the law
  • Sentencing errors by the judge
  • Defense counsel errors

Just because your trial ended in a conviction does not mean that you should give up even if there apparently are no grounds for an appeal, or your appeal has been denied. An established criminal defense lawyer may in reviewing and evaluating your case determine that another post conviction remedy such as a writ of habeas corpus or writ of mandamus could be effective in your case. Finding out what your legal options are could affect the rest of your life.

California allows for certain convictions to be expunged upon completion of a sentence or term of probation. This can clear your record of a prior conviction if you are eligible. A Governor’s pardon is another avenue to removing obstacles to employment and obtaining professional licensing among other benefits. While a pardon does not remove the conviction from your record, it can allow you to move on. Discuss your circumstances with a criminal defense lawyer at Wise Law Group, PC who can help you navigate the process.

My name is J.M. and as a police officer, I was shocked and appalled when I was falsely charged with crimes I did not commit. Mike Wise got the case thrown out of court and even got the judge to declare me factually innocent. Cops know who the good attorneys are. When I was falsely accused of a crime...
