Penalties for DUI

The penalties for DUI in our state can be extensive, even for a first offense. Below is a list of the penalties for DUI offenses, which can be increased in circumstances in which an “aggravating” factor is present, such as injuries to a passenger or other motorist, or the presence of a child in the vehicle at the time of the offense.

  • First DUI offense: $1,000 in fines, loss of drivers’ license for 6 months, 3 to 5 years of probation, 48 hours of required jail time.
  • Second DUI offense: $1,800 to $2,800 in fines, loss of drivers’ license for 2 years, 3 to 5 years of probation, 96 hours of required jail time. Some counties will insist on 10 to 30 days of jail time.
  • Third DUI offense: $1,800 to $2,800 in fines, loss of drivers’ license for up to 3 years, 3 to 5 years of probation, 120 hours of required jail time. Some counties will insist on 210 days to 12 months of jail time.
  • Fourth DUI offense: A fourth DUI in 10 years is considered a felony, and may carry penalties that include permanent loss of one’s drivers’ license and 3 years in state prison.
